If your claim is for less than $5,000, you may also file a lawsuit in
Small Claims Court.
- You must go to the Small Claims Court and fill out a form.
- You will need to bring the names and addresses of the employers you are suing.
- If you file a claim for unpaid wages in court, be sure to include liquidate damages and interest. Liquidated
damages are in addition to your unpaid wages to which you are entitled if your employer violates the labor law.
You can receive at least 25% damages on all unpaid wages. You may also be able to get to 100% of minimum wage
and overtime violations in the last two or three years under the federal law.
