Nature of Claims: In the wake of District of Columbia v. Heller, which provided national guidance regarding the applicability of the Second Amendment to gun possession cases, we have drafted a model motion to dismiss charges of gun possession to incorporate the Heller argument. Cases in which a gun is found in a person’s home or business have a much stronger defense as a result of Heller and the motion/memorandum should be used in many cases.
Current Status: We are in the process of drafting a new memorandum of Law.
