Nature of Claims: Our client is a 72 year old grandmother with an otherwise clean record who needs the car for her personal use. Following her conviction for DWI the court held that it did not have any discretion to order the return of the car to our client. We have won many cases and established much due process law in the pre-conviction stage. The question is whether the conviction ends any possibility of the return of the car. The court granted summary judgment in favor of the Property Clerk, however, in a Motion to Reconsider it granted a stay of forfeiture pending appeal.
