Today The Court of Appeals Hears The Appeal In The 18-B Litigation

On behalf of The Legal Aid Society, Daniel Kolb, a Vice Chair of the Society and a partner at Davis Polk & Wardwell LLP, will argue the appeal in the 18-B litigation before the New York Court of Appeals today. Both the Appellate Division, First Department and the trial court found previously that the City has the legal authority to assign The Legal Aid Society a combination of non-conflict and conflict cases as part of the City's indigent defense plan. Several county bar associations commenced this litigation to challenge the City's plan, which the Society is supporting. At the time of the First Department decision in March of this year, Steven Banks, the Society's Attorney-in-Chief , said that the Society was gratified with the decision "so that we can receive the case load and the associated funding we need to maintain our staffing and comprehensive client services."
