Employment Law Unit Win Benefits for Nail Salon Worker

Aaron Halegua, a staff attorney in the Employment Law Unit and a Skadden Fellow, won a major victory for a nail salon worker who was denied unemployment benefits after a wrongful termination.

Ms. A had requested and was granted six weeks vacation because of a pressing family matter. When she returned to work, the employer told her that she had been replaced. She applied for unemployment benefits, but her boss told the Department of Labor that she had abandoned her job and she was denied. The Chinese Staff and Workers Association referred her to The Legal Aid Society where Aaron Halegua took the case. After a two-year struggle, including two appeals, Ms. A. finally was awarded her unemployment benefits.
