Scott v. City of New York, 07 Civ. 3691 (S.D.N.Y.)

Nature of Claims: Excessive force by jail staff. This action, filed in May 2007, seeks damages for the June 2006 beating of Maurice Scott, a pre-trial detainee, in the George Motchan Detention Center on Rikers Island. During a housing area search by the Emergency Services Unit (ESU), he failed to strip his bed as quickly as an officer desired, and the officer punched him in the face. He fell to the floor, and the officer continued to punch him in the eye, forehead, and jaw. He was then sprayed with a chemical agent by other ESU officers who had entered his cell. He tried to get under the bed and hold onto the bedframe to protect himself, and an officer stomped on his hands. After he let go of the bedframe, he was handcuffed and then punched several times in the ribs. He was diagnosed as having a broken eye socket, in addition to the multiple bruises to face, back, and wrists that had been inflicted on him. Rather than contesting the case, the City settled in September 2007, before commencement of discovery, for damages of $175,000.
