Miller v. City of New York, 08 Civ. 4577 (PAC) (S.D.N.Y.)

Nature of Claims: Excessive force by jail staff. Mr. Miller died after an altercation with jail staff at the Bellevue Hospital prison ward in May 2007. The complaint, filed in May 2008 on behalf of his mother, as administratrix of his estate, alleges that he was beaten in the intake area of the prison ward, where there were no civilian employees or other prisoners present, and where he sustained lethal blunt force trauma to the heart.

Current status: Pending. The case was stayed pending the conclusion of a criminal investigation which was open for over two years and resulted in no action. Some limited discovery has been ordered.
