Right to Continued Health Insurance Coverage for Children Leaving Foster Care

Hundreds of our young clients leave foster care each year to return home, be adopted, or live independently. On their behalf, the Juvenile Rights Practice and the Civil Practice Health Law Unit are involved in intensive negotiations with the New York City Administration for Children’s Services, the New York City Human Resources Administration, and the New York State Department of Health to ensure that children do not lose or suffer gaps in Medicaid coverage during these transitions. Children in foster care are legally entitled to have their coverage continue, without interruption, when they leave foster care.
